Terms of Service

1. Agreement

These terms govern your use of EmployIQ, an AI receptionist platform for small businesses. By creating an account, you agree to these terms. If you're signing up on behalf of a business, you confirm you have authority to bind that business.

2. The service

EmployIQ provides an AI-powered receptionist that can answer phone calls, respond on WhatsApp, book appointments, answer questions from a knowledge base you configure, and generate invoices with payment collection, depending on your plan.

3. AI limitations

EmployIQ's AI receptionist is designed to be accurate and helpful, but like any AI system it can make mistakes. You're responsible for reviewing the business information, pricing, and policies you provide it, and for verifying anything business-critical (bookings, invoices, customer communications) before relying on it. EmployIQ is not liable for losses arising from AI errors, to the maximum extent permitted by law.

4. Accounts and plans

You're responsible for keeping your account credentials secure and for all activity under your account, including staff members you invite. Plans (Starter, Business, Pro) differ in included features and team size, as described on our pricing page.

5. Billing

  • New accounts start with a 14-day free trial. No card is required to start the trial.
  • Subscriptions are billed monthly in advance via Paystack.
  • You can cancel or change your plan at any time from your dashboard's Billing page. Cancellation takes effect at the end of your current billing period; we don't provide partial-month refunds.
  • Invoices you generate for your own customers, and any payments they make through EmployIQ, are between you and your customer — EmployIQ facilitates the payment via Paystack but is not a party to that transaction.

6. Acceptable use

You agree not to use EmployIQ to:

  • Send unsolicited spam or unlawful marketing messages.
  • Harass, defraud, or mislead your customers.
  • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the platform.
  • Use the service for any purpose that violates South African law.

We may suspend or terminate accounts that violate these terms.

7. Your data

You own the data about your business and your customers that you put into EmployIQ. See our Privacy Policy for how we handle it. If you cancel your account, you can request a copy of your data or its deletion.

8. Availability

We aim to keep EmployIQ available and reliable, but we don't guarantee uninterrupted service. Third-party providers we depend on (WhatsApp, Twilio, payment processors) can also affect availability outside our control.

9. Limitation of liability

To the maximum extent permitted by law, EmployIQ's total liability for any claim arising from your use of the service is limited to the amount you paid us in the three months before the claim arose. We're not liable for indirect or consequential losses, including lost profits or lost business.

10. Termination

You can close your account at any time. We may suspend or terminate accounts that breach these terms, don't pay outstanding fees, or pose a security risk to the platform.

11. Governing law

These terms are governed by the laws of South Africa, and any disputes will be subject to the jurisdiction of the South African courts.

12. Changes

We may update these terms from time to time. Material changes will be communicated to account owners by email before they take effect.
